Meet Our Attorneys

Michael Smolka

A graduate of the John Marshall Law School, (now UIC – John Marshall) Michael became an attorney after being on the other side of the table and watching the fight to spend time with his son play out in a Family Law courtroom. Providing a unique understanding of the client’s perspective together with knowledge of the ins-and-outs of the legal process, Michael offers the highest level of representation and advice to clients with all issues related to divorce and family law, including: parenting time and allocation of parental responsibilities (custody), child support and maintenance, enforcing or changing terms of an existing court order, paternity, and prenuptial agreements. 

In addition to Michael’s work as an attorney he has served the Palatine community as a member of the Board of Education of Community Consolidated School District 15 when he was elected in 2017. In 2021 Michael was elected to serve the Palatine community as a Trustee of Palatine Township.

Michael’s real-life experience, coupled with his extensive knowledge of navigating a Family Law courtroom provides an unparalleled ability to represent your best interest and the vision to see your case from your perspective and anticipate your needs.

Nick Banahan

Nick joined Smolka Law Group as an associate in 2021. He concentrates his practice in family law, estate planning, and real estate closings.

A current resident of the northwest suburbs, Nick attended the University of Louisville where he received a Bachelor’s of Arts degree and majored in Sports Management Nick received his J.D. from University of Illinois-Chicago, John Marshall Law School..

While in Law School, Nick clerked with the City of Chicago in the Building and License Enforcement Legal Department. While with the City of Chicago Nick worked in conjunction with the Departments of Buildings, Housing, and Police in an effort to identify and abate vacant and deteriorated properties throughout the City of Chicago.

Nick also interned with the Chicago Legal Clinic at the Foreclosure Advice Desk. He gained valuable courtroom experience working with his 711 License at the Foreclosure Advice desk.

Prior to joining Smolka Law Group as an Associate, Nick clerked for Smolka Law Group while finishing his education and studying for the Bar exam. Nick’s experience has given him the tools necessary to competitively navigate the litigation process and best serve the interest of his clients.
